BIC Tip #1063: All Compensation Must Flow Through the Firm

n North Carolina, the rules for handling real estate compensation are crystal clear — all money must flow through the firm. This requirement is not just a technicality; it’s a cornerstone of compliance that protects both consumers and brokers.

What the Rule Means

Whether it’s a commission, referral fee, or bonus tied to brokerage activity, all payments must be made to the firm first. After receiving compensation, the firm then distributes the appropriate amounts to affiliated brokers according to their independent contractor agreements.

What Brokers Cannot Do

A broker may never accept direct payment from:

  • A client,

  • Another broker, or

  • Any third party outside of the firm.

Taking money “under the table” — even with good intentions — violates NCREC rules and puts your license at risk.

Why This Matters

This requirement exists to:

  • Protect consumers by ensuring accountability.

  • Maintain transparency in financial dealings.

  • Clarify relationships between brokers and their firms.

  • Reduce disputes by keeping all compensation properly documented.

The Bottom Line

👉 If you didn’t get paid through your firm, you didn’t get paid properly.

Handling compensation the right way keeps you compliant, your firm protected, and your professional reputation intact.
