BIC TIP #1099: Final Walkthrough Problems
he final walkthrough is not another inspection. It is the buyer’s last opportunity to confirm that the property is in the condition the contract requires before closing. When the buyer discovers a problem during this walkthrough, emotions can run high and pressure builds quickly. As the agent, your job is to clearly explain the buyer’s options and help them make an informed decision.
During a final walkthrough, a buyer may discover issues that are frustrating, but the solution is usually simple. Under North Carolina contract law, when a problem is discovered at the final walkthrough, the buyer must choose between:
1. Delay Closing
The buyer may postpone closing until the seller corrects the issue, replaces the fixture, or completes the repair properly. This option can create scheduling challenges, but it preserves the buyer’s rights and expectations under the contract.
2. Accept the Property as-Is
If the buyer prefers to move forward anyway, they may close and accept the property in its current condition. This choice ends the issue, but they are effectively choosing to absorb the problem themselves.
There is no automatic credit, no guarantee of repair, and no requirement for the seller to negotiate at the last minute. The buyer must decide how strongly they feel about the issue and whether it is worth delaying the closing.
Clear communication at this stage prevents surprise, reduces conflict, and protects your client from making a rushed or poorly informed decision.
