💰 BIC Tip #1071: Beware the Bonus Trap

Watch Stephen Long explain how compensation should be paid to brokers in NC

Everyone loves a good bonus — but in North Carolina real estate, the wrong kind can cost you your license.

Builders, sellers, and landlords often offer “incentives” or “bonuses” to agents for bringing buyers or tenants. Sounds great, right? Not so fast. Under North Carolina law, brokers can only receive compensation through their firm — not directly from anyone else.

That means if a builder hands you a gift card, cash, or even a thank-you check, and it didn’t run through your firm first…
💥 You’ve just violated NCREC rules.

⚖️ The Rule is Simple

All compensation related to brokerage activity — whether commission, referral, or bonus — must:
1️⃣ Be disclosed, and
2️⃣ Be paid through your firm.

That includes:

  • Builder bonuses

  • Tenant placement incentives

  • “Thank-you” gifts

  • Cash cards, prepaid cards, or Venmo transfers

Even a small incentive counts.

🚫 What Happens If You Don’t

Accepting direct payment from anyone other than your firm can trigger disciplinary action under NCGS § 93A-6(a)(9) and NCREC Rule 58A .0109(d).

It can also create IRS reporting issues, confuse accounting records, and — worst of all — make your firm look like it’s running a side business.

✅ Best Practices for Brokers

1️⃣ Always disclose bonuses to your BIC before accepting.
2️⃣ Have the firm collect and disburse all payments.
3️⃣ Educate your clients and partners — they often don’t know this rule.
4️⃣ Say “no thanks” to direct pay. Protect yourself and your license.

🧠 The Notorious Truth

Fast money feels good — but clean money keeps you in business.

If it didn’t come through your firm, it didn’t come through the law.
Simple as that.

BIC Bottom Line:
Get paid the right way, every time.
Bonuses are fine — if they’re compliant.
